After reading this post i'm now flapping as I have a caution from March 2007. I'm pretty sure it was a two year one for public order, can't remember the exact details, but basically an argument with a very drunk bloke on a night out and then his mates jumped in. I was told by the police that I had the opportunity to run away but because I decided to stay and defend myself, the other people could try and press charges for assault. The police were really friendly with me and treated me really well, and basically explained I was only kept in as a formality. When they presented the caution to me the officer said, because I didn't run away and stood my ground it would go to court if I didn't accept the caution (at this point i flapped about loosing my licence), the officer then said that the caution was just a slap on the wrist and i was only getting it offered to me due to the circumstances, and gave me the impression that it was the better option!! If I'd have known what I now know I would have gone to court because I was later told by another officer I know personally that they had cctv of the whole incident. Now i'm thinking that it might affect my CP renewal at the ned of the year!!

I got told i was getting a "final warning" when i was a minor.
And it would be off my record within 2 years.

I got a CRB done 2 years after that, and i had a caution on it.

The sia CRB checks include anything that may suggest you not being a fit and proper person to hold the licence in question. I can only comment in respect to the CP licence.

It would appear that cautions are deemed negatively by the SIA as a matter of procedure. Spent convictions are also taken into account. The tendency is always to reject an application. It is then up to you to appeal to the SIA.

I have personally helped quite a few people out over the past year or two where their applications were refused, by giving a character reference and other supporting evidence. All subsequently received their licence. It depends on the circumstances. I'm happy to give personal advice for what its worth to anyone who wants to PM me.

So if you don't accept a caution, what will the police actually do?
They need to justify the hours spent collating statements, ticking boxes etc etc. So what would be the up-shot if I said 'Officer, I do not recognise, or accept ,the caution you are about to give me?'
Would he just jump the charges back up to ABH? GBH even?

Any serving or ex-police officers, please give me your opinions on this.

Let me know guys. Think quite a few people are having the same problem as I did with my badge and think someone needs to speak up on behalf of us!!!

Let me know

Ray
The sia don't give toss about criminal convictions. I know this for a fact. I am aware of several people that I would NEVER have thought would be granted a licence were given one. One of them has over 30 convictions for TWOC, theft, deception, armed robbery etc etc going back to 1984, including a 7 year stretch for the armed robbery and he was granted a DS licence............ It makes a mockery of genuine honest people who believe that the licencing systems works. Although we shouldn't expect anything less from the SIA, after all they were issuing licences to illegal immigrants at one point.

Once you have been given a formal police caution it stays on your record, period, dont let any copper try to tell you any different they are just after reducing the paperwork, dont trust any of them if they tell you its raining go and have a look yourself.
