Default licence appeals sia

Iv come to renew my door supervisor licence and its been minded to refuse for an offence i commited just after id recieved my badge 3 years ago for producing a false instrument to decieve (dodgey car insurance) under forgery and counterfieting act, i got 40 hours community service that is the minimum amount ov hours there could ov giv out. My licence has falling into the straight fail catogery that means no appeal by letter has to go to court, i have been working security during the day doin upto 60 hours and working doors on a night to make ends meet however iv been forced to go on dole because off this refusal, does anyone no my chances ov geting my licence back at court and been able to work for a living again for an isolated 1 off offence.

James570, please do not take this the wrong way, but, the law is the law and the rules are the rules, regardless of the circumstances.

You probably don't want to hear this, but as you have given up your cirumstances on a public forum, then people will comment.

Fraud is fraud, regardless of your reasons for doing it and the sia is there to prevent people with criminal records from gaining professional licenses, depending on the offence committed.

No-one has forced you to go on the dole, pick yourself man and get back out there and find a job, doing something else in the mean time.

Go to your CAB and ask about their free sitting with a lawyer. As you may no longer have the funds, you could/should be able to use the Legal Aid route to go to court and state your case. At least then, you maybe abe to state your case to an impartial magistrate, just like people can sometimes stop a driving ban becuase of their loss of income....

Worth a try anyway, don't give up though, make the calls, get to the Citizens Advice Burearu local to you.

No-one on here can really tell you what a court will say, maybe you can tell us when it's over.

Hindsight is a wonderful thing and I guess this is a good example for everyone to keep their noses clean for the future of their license.

We all made enough noise when there wasnt an SIA with rogue/cowboys doing the work, now we have one, guess we just have to live with it.

Chin up.....

Andy

sad fact is that you committed an offence and you may have served your time, but one thing the sia is good at (suprisingly about only thing) is this. You could try an appeal at court i have heard it has helped some in the past but personally i think you may be on to a no win situation there. Try maybe contacting the London office and seeing what they have to suggest, but i'm afraid i would not be too confident.

There rules on criminal offences are quites strict, and they are unlikely to make allowances following the recent business with illegal immigrants and licencing being such a public matter.

Good luck with trying though and hope it works out for you

ive been working in security 6 years with realy good refrences from anyone ive worked for, i could work for again with licence, you would think that a court off law would giv consideration to the fact that by working id be putting something into the country rather than taking all the time like some off the people i met on community service with no go in them or will to get a job at all and are happy to take drugs and keep reoffending laughing at the system. im no threat to public safety, i changed dates on my cover note for insurance and im put in the 5 year bracket with serious assaults rapists and gun crime. iv made apointment with soliciter 2moro so i will keep forum informed for future experience, was wondering if anyone had similair case, or will courts stick by s.ia,s decision, as i could be chasing lost corse as im practicaly goin agaisnt the government.

Stick to you guns, state your case, as you have here, you have nothing to lose, especially as Legal Aid should cough for it all.

Ive been for some advice from a soliciter yesterday he told me that if he pursued this case he wud probably fail and id have to pay him 500 quid upfront for his reprisentation or the other option would be to go down the magistrates court myself and register the appeal and do it all myself, homever if he thinks he will lose what chance have i got on my own, not sure if i should give up or seek more advice.
