QUESTION:

Hi i currently work abroad on a rotation of 28 days out and 6 days back, where do i stand on paying tax? i am registered as self-employed in uk

ANSWER FROM WHITTAKERANDCO ACCOUNTANTS

My calculations show that with the rotation you are doing that your actual time spent in the UK is 72 days. If this is correct then you should not be set up as self employed in the uk and instead put in an application for Non_residency (P85) could be missin something but on a 28 day on 6 day off rotation you more than meet the guidelines, I have not even included travel days into this.

Travel days count as of the new tax year, days travelling in to and out of the UK are classed as UK days.
Providing you don't spend more than 90 days in the country in any tax year, then you should be able to register yourself as tax free. Get yourself a decent accountant and ensure you do it above board. Keep all your airline stubs and copies of rosters, etc.
The rules are quite complex, these are just basic guidelines and there will be other who give you more advice but, speak to an accountant as soon as you can to avoid the pitfalls.

As of April 2008 travel days are excluded, this could mean that if visit the UK 4 times within the tax year April 2008 - April 2009 then you are only allowed to spend 82 days in the UK.

However with tax returns as we work a year beind, the next tax return due by the deadline date of 31st Jan 2009 is for the tax year April 2007 - April 2008 where travel days are still included.
